A trust is a legal arrangement in which an individual (the grantor) gives fiduciary control of the property to a person or institution (the trustee) for the benefit of beneficiaries. Trusts can provide protection of an individual’s assets during their lifetime or in the event of a disability and can be structured to ensure the support and security of a decedent’s family, usually with significant tax savings. The Trust Department administers the assets according to the instructions in the written trust document.
Estate Administration & Guardianship
Estate Administration, or probate, is the process by which the estate (property) of a deceased person is distributed to heirs at law. The Trust Department, acting as executor or administrator, performs duties prescribed by the probate process – including preservation and management of assets, payment of expenses, preparation of tax returns, and making distributions per will or statute – in a timely and professional manner.
Certain individuals are not legally able to handle their own affairs because of age or incapacity. Upon a petition of an interested person, courts may appoint an individual or financial institution as guardian or conservator to handle the financial affairs of a minor or an incapacitated individual. The Trust Department, as guardian of a person’s estate, performs many duties including managing and investing assets, paying expenses, preparing and filing income tax returns, and submitting periodic reports to the court for its review.
